PRIVACY POLICY
MyResQ Application (after this referred to as “MyResQ App”) provides the public with last mile emergency response function. MyResQ App is owned and operated by MYRESQ SDN. BHD.
When you log in to the MyResQ App;
- Alert the system on a cardiac arrest case
- Communicate with other rescuers when there is a case being alerted
- Receive call notifications regarding active cardiac arrest case alerted around you
- Receive push notifications regarding active cardiac arrest case alerted around you
- View other active cases around you
- View the presence of other rescuers around you
- View and locate Automated External Defibrillator (AED) around you
- View the video of training on CPR, Choking management and AED usage
You need to understand what information MyResQ App collects and uses and how you can control it. We explain it in detail in our privacy policy; you can review the key points below.
- MyResQ Information
We gather information directly from you via MyResQ App. The information we collect or gather includes any information you share with us, for example, your name, ID number, email address, occupation, organization, work ID or certificate and contact number.
- Camera and Microphone
MyResQ App uses your device’s camera and microphone for video consultation and voice messages. The camera and microphone access are required to allow your interaction with the rescuer for identity verification purposes, to capture case pictures and communicate with other rescuers.
- External Storage (Images, Videos, Files)
MyResQ App collects and stores the data collected, for example, name, ID number and photo, email address, occupation, organization, work ID or certificate image and contact number, from the uploading, downloading, and sharing of online results, active cases, live chat and AED. Storage access is required to share the information for delivery and monitor communication with you.
- Location
MyResQ App collects location data via GPS for a suspected cardiac arrest even when the app is closed or not in use. The Location Access is required to correctly identify your location to assist in a cardiac arrest response within 500m.
- USE AND COLLECTION OF PERSONAL DATA
MyResQ App respects and is committed to protecting your personal data and information shared with us in strict accordance with the requirements of the Personal Data Protection Act, Malaysia, 2010 (PDPA), General Data Protection Regulation (GDPR) and Malaysian Communications and Multimedia Commission Act 1998 (MCMC) standards. The Personal Data collected will not be used for any purpose other than stated. This Privacy Policy explains how we collect and handle your personal information. Please take a moment to read this Privacy Policy so that you know and understand the purposes for which we collect, use and disclose your Personal Data.
- DISCLAIMER NOTICE
You will not have access to your MyResQ App unless you have agreed to this privacy policy. By accessing and using any part of the MyResQ App, interacting with us, submitting information to us, or signing up for any services offered by us, you acknowledge that you have read and understood this privacy policy and agree and give consent to MyResQ App, as well as its representatives and agents, to collect, use, disclose and share amongst themselves your Personal Data, and to disclose such Personal Data to our authorized service providers and relevant third parties in the manners outlined in this Privacy Policy.
This Privacy Policy supplements but does not supersede nor replace any other consents you may have previously provided to MyResQ App in respect of your Personal Data, and your consents herein are additional to any rights which any member of MyResQ App may have at law to collect, use, or disclose your Personal Data.
- CHANGES TO THE PRIVACY POLICY
Please note that MyResQ App may amend this Privacy Policy at any time without prior notice. This latest version of our privacy policy was updated on 20th January 2023. It will be regularly updated as new features requiring explanation are added and further clarity is needed. We will notify you of the such amendment via our website, app, or email. - PERSONAL DATA COLLECTION
MyResQ App collects data with the user’s consent and is done voluntarily through, but not limited to, the registration process, adding automated external defibrillation information, communicating with other rescuers, and contacting app support via email or technical support form.
4.1 The types of Personal Data that MyResQ App collects directly from you or third parties may include but are not limited to your details (such as name, age, gender, identity card number, passport number, and date of birth) contact details (such as an email and phone numbers), occupation details (such as employer or organization name, job title), device model (such as device ID, device GUI version, device type, device manufacture), device location (via GPS), photographs, and other images and other information relevant to the patient and/or customer surveys, education and/or offers and/or additional information (in respect of other facilities and/or services used by you).
4.2 In addition, the app may, from time to time, request certain other personal information that may be relevant for the app to consider your request for any other service or facilities of the app.
4.3 All information requested is obligatory to be provided by you unless stated otherwise. We would be unable to process your request and/or provide you with relevant facilities and/or services and/or transactions should you fail to provide the required information.
- HOW DO WE COLLECT YOUR DATA
5.1 The permission to access the following functions below is required for the best experience using the MyResQ App. You are deemed to have given consent when you click the “Allow” button in the application.
5.2 MyResQ obtains any Personal Data via-
- sign up via the MyResQ app;
- any online sites operated by MyResQ;
(Phone function)
- Files in media/shared storage; We require access to your local device storage to store files that are available in our app. This permission is necessary to ensure you can view the files accordingly, set up your profile picture, and upload photos of your identification card and certificate.
- Camera; The use of the Camera function for the features including but not limited to verification upon registration, user profile picture, case photo and AED photo;
- Device location service via GPS; We require access to your location data and your real-time location to allow us to notify you of nearby cardiac arrest cases within 500 metres and for you to access the nearest available AED device.
- Phone Call; To receive OTP messages for verification purposes and to receive an alert call from app’s server upon cardiac arrest case activation.
- Access Device and Browser Information; When you access the website from a computer or other device, we may collect anonymous information from that device, such as your Internet protocol address, browser type, connection speed and access times;
- Device information: We may also collect non-personal information from your mobile device, such as system version, device id, device model, and device manufacturer. This information is generally used to help us deliver the most relevant information to you. Examples of information that may be collected and used include how you use the application(s) and information about the type of device you use. In addition, if our application(s) crashes on your mobile device, we will receive information about your mobile device model software version and device carrier, which allows us to identify and fix bugs and otherwise improve the performance of our application(s).

- voluntary provision of data to the third-party service provider(s) engaged by us;
- a person acting on behalf of the individual whose data are provided;
- any other contractual agreement or arrangement;
- business directory(ies) or listing(s) that you have subscribed to share your information;
- other sources and related links that are relevant to providing your needs and services.
- HOW DO WE USE YOUR DATA
The purposes for which collected data may be used and/or processed are as follows:
- to verify your registration;
- to provide the service requested by such an individual;
- to tailor our services within our MyResQ App to your current location;
- to see the number of registered responders, registered cases and how many cases activated in a day and month;
- to alert you via phone call and push notification when there is a cardiac arrest case being reported by other users;
- to tailor our services within our app to your current location;
- to send you surveys by email or other digital means to solicit feedback about our MyResQ App and services;
- to contact you regarding products, services, upcoming events, promotions, advertising, marketing, and commercial materials which we feel may be of interest to you;
- to enhance, maintain and troubleshoot our MyResQ App;
- to administer and communicate with you concerning your life-saving intervention;
- for insurance purposes;
- for internal investigations, audits or security purposes;
- to conduct internal statistical analysis;
- to analyze case studies;
- to send surveys via email or other digital means to solicit feedback about our MyResQ App products and services;
- to administer and communicate concerning MyResQ App’s services and/or events; and
- for prevention, hindrance, and reporting of any crime, including but not limited to fraud, bribery and money laundering;
- DISCLOSURE OF DATA
7.1 Data held by MyResQ App relating to an individual will be kept confidential, but MyResQ App may provide or disclose such information to the following parties (whether within or outside Malaysia):-
- relevant third parties (in or outside of Malaysia) as required under law, according to the relevant contractual relationship or for the purposes stated in paragraph 6 above;
- in the case of pre-employment health screenings, to the patient’s employer / prospective employer;
- MyResQ’s agents, servants and/or such persons;
- independent consultants and specialists within MyResQ App;
- professional advisers such as external auditors, legal advisors and/or financial advisors or any other third party required by law, regulation or by-law, subpoena, court order or other legal processes;
- governmental agencies, governmental authorities and other regulatory bodies;
- third-party payers, including employers, insurance companies and clinical sponsors;
- third-party reward, loyalty, co-branding and privileges programme providers;
- selected third parties, such as business partners.
7.2 Personal Data may also be disclosed or transferred due to any restructuring, sale or acquisition of any company within the MyResQ App.
7.3 Where MyResQ App deals with third parties, specific security and confidentiality safeguards will be implemented to ensure your data protection rights remain unaffected.
- AUTOMAED EXTERNAL DEFIBRILATTOR (AED) DATA
MyResQ App records AED data uploaded by our registered users, including location, images, etc. We also store personal data affiliated with the AED, for example, the identity and contact details of the guardian (if known) or the individual who uploaded the AED data. Most guardians are companies/organizations that, for example, have AEDs on their premises. The lawful basis for storing this data is the legitimate interest in that the data is required to be able to inform people of AED locations and their availability. MyResQ App does sell AEDs but has no vested interest in AED data. We display data within the Apps in an open but location-controlled manner – you can only see AEDs close to your current location.
- DATA STORAGE AND SHARING
Data in transit are encrypted, while data at rest is stored in a highly secured environment. Your personal information will not be shared with other agencies unless Government Authority uses it.
- KEEPING YOUR DATA SECURE
Security is central to MyResQ App, and we take the security of our users very seriously. Unfortunately, the transmission of information via the internet is never completely secure. Whilst we cannot guarantee the security of your data transmitted to our site, any data is at your own risk. We use strict procedures and security features to prevent unauthorized access. All staff are trained in properly handling personal data and observe our Data handling policies. All staff actions on our system are auditable, and staff are only provided with access to areas of our system according to their role.
- HOW LONG WE KEEP YOUR DATA
We will retain your data for as long as you wish to be communicated with us or use our app and for a reasonable period since you ceased utilizing the app. The period we keep the data will vary depending on how long we need the personal data to deliver, maintain or improve our services or whether we require the information as part of a dispute or to comply with a legal obligation. Please note that we may also be required to retain certain information by law.

You have the right to:
- Know how your data is being collected and used
- For what purpose is your data used
- Request to obtain information, correct or update your personal data, limit the processing of your personal data and/or deletion of your personal data.

Following the terms of the PDPA, MyResQ has the right to charge a fee for processing any data access request.
MyResQ may also refuse to comply with a request for access or correction to personal information.
- WITHDRAWING CONSENT
You are entitled to limit our processing of your personal data by expressly withdrawing in full your consent which is given previously, in each case, including for direct marketing purposes, subject to any applicable legal restrictions, contractual conditions, and within a reasonable amount of period. You may opt out of receiving any communications from us at any time by sending a request to [email protected].
- COMPLAINTS
Suppose you have any queries or complaints relating to this Privacy Policy or otherwise relating to misuse or suspected misuse of your personal information. In that case, you may send us a message via [email protected].
- OTHER INFORMATION
15.1 CHILDREN’S PRIVACY
In the interest of children’s privacy, we do not knowingly collect personal information from or target end-users under 18. Our app was neither developed for nor designed to attract anyone under 18. Minors under the age of 18 may not use the app or website. Suppose we learn we have collected or received information from a child under 18 without verification of parental consent. In that case, we will endeavour to delete that information.
15.2 Links to Third-Party Websites
Parts of our App may contain links to third-party websites not owned by MyResQ (“Third Party Websites”). When you access Third-Party Websites, please understand that we do not control the content of that Third-Party Websites. We are not responsible for the privacy practices or the content of that Third-Party Websites. This Policy applies only to our site. You should be aware that other sites linked by this website may have different privacy and personal data protection policies. We highly recommend that you read and understand the privacy statement of each site. We accept no responsibility or liability for third-party materials or the operation or content of other websites (whether or not linked to our app). Those are not under MyResQ’s control.
